TOPIC OVERVIEW: Our guest speaker, Peyton B. Engel with Hurley Burish, S.C. will be presenting on the topic: Diving Deeper into Digital Evidence.
LEARNING OBJECTIVES/OVERVIEW:
Every case involves digital evidence to one degree or another, but much of the time we treat electronic documents as being equivalent to their paper counterparts. There are fundamental differences, and they have implications for the way we collect evidence, how we analyze it, how we should handle it, and how we can use it in court.
This talk will focus on the technology of digital evidence, and the implications it has for us as members of the legal profession. Topics covered will include:

The life-cycle of digital evidence from collection to disposal

Technical wrinkles: recovery of deleted items, mobile device forensics, metadata, etc.

What do the rules of professional conduct permit, and what do they prohibit, with respect to digital evidence

Digital evidence in the courtroom: authentication, business records, and other open issues
This is not another e-discovery product demonstration or discussion of how AI will transform the legal field: it’s practical guidance to make those who work with digital evidence more effective, whether in criminal, civil, or in-house roles.
SPEAKER BIO:
Peyton B. Engel is an attorney with Hurley Burish, S.C., in Madison, Wisconsin. Peyton helps individuals and businesses with civil litigation, represents licensed professionals including attorneys in disciplinary matters, and provides consulting and expert witness services in matters where digital evidence is at issue. Before joining the firm, Peyton worked for more than 18 years in information technology, with sixteen years of that time spent specialized in network and information security. Peyton holds the CISSP certification, and the Wisconsin Law Journal has recognized him as one of the best forensic experts in the state.
He is a member of the State Bar of Wisconsin and the Dane County Bar Association. Peyton earned his B.A. from Grinnell College; his M.A. from the University of Wisconsin - Madison; and his J.D. from the University of Wisconsin Law School.
